Terms of Service

These Terms of Service (“Terms”) govern your use of the Explored mobile app and this website (together, the “Service”), provided by Guiware LLC (“we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
The Service
Explored turns the places you go into a personal map, tracking the areas you’ve covered and showing how much of your cities and states you’ve explored. We may add, change, or remove features over time, and we may update or discontinue parts of the Service.
Eligibility
You must be at least 13 years old, and old enough to form a binding contract in your jurisdiction, to use the Service. By using the Service, you represent that you meet these requirements.
Your Account
Some features require an account. You are responsible for keeping your account credentials secure and for the activity that happens under your account. Please provide accurate information and let us know promptly if you believe your account has been compromised.
License to Use the Service
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Explored for your own personal, non-commercial use. You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Service.
- Reverse engineer or attempt to extract the source code of the app, except where this restriction is prohibited by law.
- Use the Service in any unlawful way, or to infringe the rights of others.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its related systems.
Purchases
Explored is a paid app. Purchases are processed by the Apple App Store and are subject to Apple’s terms. Pricing may change over time. Refunds are handled by Apple in accordance with its policies; please contact Apple for refund requests.
Location and Safety
Explored relies on your device’s location and is intended for recording where you’ve been — not for real-time navigation, routing, or emergency use. Do not interact with the app while operating a vehicle. Features intended for use in a vehicle, such as Cabin View, are meant to be viewed passively or operated by a passenger. Location data can be inaccurate or unavailable, and you should not rely on the Service where accuracy is critical.
Intellectual Property
The Service, including its software, design, and content, is owned by Guiware LLC and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding. Map and reference data may be provided by third parties and remain the property of their respective owners.
Third-Party Services
The Service may rely on or link to third-party services, including the Apple App Store, mapping and reference data providers, and, for Cabin View, a compatible vehicle’s browser. We are not responsible for third-party services, and your use of them may be subject to their own terms.
Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely accurate.
Limitation of Liability
To the fullest extent permitted by law, Guiware LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the extent we are found liable, our total liability will not exceed the amount you paid for the Service.
Indemnification
You agree to indemnify and hold harmless Guiware LLC from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms.
Termination
You may stop using the Service at any time and may delete your account. We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that could cause harm. Provisions that by their nature should survive termination will continue to apply.
Governing Law
These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which Guiware LLC is organized, without regard to conflict-of-laws principles.
Apple App Store Terms
The following additional terms apply because you obtained Explored through the Apple App Store:
- These Terms are between you and Guiware LLC only, not with Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support for the Service.
- In the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
- Apple is not responsible for addressing any claims relating to the Service, including product liability, legal or regulatory compliance, or consumer protection claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
